Order Limits Number and Duration of Depositions in NY’s Busy Commercial Courts Effective April 1, 2015

Today, on December 21, 2014, Chief Administrative Judge A. Gail Prudent issued an order adopting a new Rule 11-d of the Rules of Practice for the Commercial Division which will limit parties to taking 10 depositions of no more than seven hours in duration per person. The Rule permits parties to stipulate to more or longer depositions and Commercial Division judges can order exceptions for “good cause.” The new rule will go into effect on April 1, 2015.
